BACKGROUND FOR MEMBERSHIP TRANSFER POLICY

Purpose

To insure that membership transfers are promptly completed.

Scope

This policy applies to all prospective or existing members acquiring a membership by transfer. 

Introduction

A water membership represents the right to connect to the OWU water system, thereby enhancing the value of the property.

Olga Water Users, Inc. (OWU) was incorporated in 1936. Article V of the Articles of Incorporation states, in part:

 β€œThe corporation shall issue membership certificates, which certificate shall be assignable under such provisions, rules and regulations as may be prescribed by the by-laws of the corporation.”

Procedure

A transferred membership requires that OWU have the following items on the transfer procedures list:

  • A current recorded OWU easement

  • An application form from the new owners

  • Current name and contact information

  • Current Tax Parcel Number

  • All fees and charges paid

  • Any other documents intended to conform the property or the water membership to OWU rules

 

The OWU Bylaws, Article VI, Section 2(d), notes that it is the original property owner's responsibility to insure that the OWU membership is properly transferred. Sometimes this is not practical and the current owner is held responsible. An example is a quit claim; these property transfers usually do not involve a title/escrow company, and OWU is not informed of the transfer.  It is the property owners' responsibility to follow through with a membership transfer.  These procedures apply in situations where OWU is not notified of the transfer by the usual methods.  

The prospective member shall present the essential information, including but not limited to, the transfer procedures list above within ninety (90) days of the property sale and that the new member meets the requirements of the Bylaws and approved procedures.

OWU may continue to provide service during a membership transfer as a matter of good will and efficiency under the reasonable expectation that the transfer will be completed promptly.

 

If the membership transfer is not completed within the specified time, the result is service being provided to a non-member.

MEMBERSHIP TRANSFER POLICY

 

To insure that a membership is promptly completed the following procedure shall be followed:

 

  1. Memberships not completed within ninety (90) days of the request ("due date") will have a late fee added to the transfer fee. A second notice will be issued. 

  2. A third and final notice will be issued one hundred twenty (120) days after the initial request. An additional late fee and a certified letter fee will be added to the amount due.

  3. Service will be discontinued ten (10) days after the final notice. A service restoration fee will be added to the amount due. 

  4. Membership will be terminated and forfeited ten (10) days after service is discontinued. 

 

 

OWU may choose to provide water or other service to the prospective member during the above time frame but is not obligated to do so, nor does the provision of such service constitute an ongoing obligation to the prospective member until such time that the transfer has been satisfactorily completed.
